Skaify Privacy Policy

This Privacy Policy describes how Skaify ("we") collects, uses, stores, and shares your personal information when you use the Skaify application (available on the App Store and Google Play) and the website skaify.com (collectively, the "Service").

This is the complete list of data categories the app may process, in the same format app stores use for their privacy label. If a category is not listed here, we do not process it.
We do not sell your personal data, we do not share it with advertisers, and we do not use it for targeted advertising inside or outside the app.

We share information with the following external service providers, only to the extent necessary to operate the Service, and we never sell your personal information for advertising purposes:
4.1 How we use artificial intelligence
Skaify runs on artificial intelligence. The conversations, plans, and recommendations you see are generated automatically by a language model, not written by a person. We state this expressly so you know exactly what you are talking to.
To generate each answer we send the model provider (Anthropic) only what is necessary: your first name, your city, the local date and time, your mood if you set one, your preferences and interests, the candidate places, and the messages in that conversation. If you turned on the calorie goal, we also send that goal and your progress for the day, which is health information.
What you write in the free text fields of your profile is part of the information we use to personalize your recommendations.
We do not send your email address, your password, your payment details, or your exact location. Under that provider's commercial terms, information sent through its programming interface is not used to train its models.
If you prefer not to share health information with the model, you can turn that feature off from your profile at any time.
5. Cookies and Similar Technologies
The website skaify.com may use cookies and similar technologies to remember your preferences, understand how the site is used, and improve your experience. You can configure your browser to reject cookies, although this may affect some site features. The mobile app does not use browser cookies, but may use equivalent technical identifiers for similar purposes.
6. Social Media Connection (Optional Feature)
If you choose to connect social media accounts such as Instagram, TikTok, or Spotify, we analyze the content of your connected accounts to personalize your recommendations. You may disconnect these accounts at any time from your profile.
7. How to Delete Your Account and Data
You can delete your account and request deletion of your personal data at any time in two ways:
Once your request is processed, we will delete or anonymize your personal information, except for information we are legally required to retain (for example, payment transaction records) for the period required by applicable law.
8. How We Protect Your Information
We implement reasonable technical and organizational measures to protect your personal information, including database-level access controls (Row Level Security) that ensure each user can only access their own information, encryption of data in transit, and access credentials kept outside the app's codebase.
9. Data Retention
We retain your personal information for as long as your account remains active, or for as long as necessary to fulfill the purposes described in this policy, or as required by applicable law.
10. Your Rights
10.1 If You Are Located in the European Union (GDPR)
You have the right to: access your personal information, request rectification, request erasure ("right to be forgotten"), restrict processing, request data portability to another provider, and object to processing of your information under certain circumstances.
10.2 If You Are Located in California (CCPA)
You have the right to: know what personal information we collect about you, request its deletion, opt out of the sale of your personal information (Skaify does not sell personal information), and not be discriminated against for exercising these rights.
10.3 If You Are Located in Mexico (LFPDPPP)
You have ARCO rights: Access, Rectification, Cancellation, and Opposition regarding the processing of your personal data.

11. Children's Privacy
The Service is not directed at individuals under 18 years of age (or under 21 for users in the United States), and we do not knowingly collect information from individuals under the applicable minimum age. If we become aware that we have collected information from a minor without appropriate consent, we will take steps to delete such information.
12. International Data Transfers
Since Skaify operates in both Mexico and the United States, and uses service providers located in different jurisdictions, your information may be transferred and processed outside your country of residence.
13. Changes to This Policy
We may update this Privacy Policy periodically. We will notify you of significant changes through the Service.
